Agreement Overview

This Dog Training Services Agreement (“Agreement”) outlines the terms and conditions between California Cattle Dogs LLC and its owners, employees, contractors, partners, agents, and affiliates, (referred to as “the Trainer” or “we”), and the client, (referred to as “the Client” or “you”), for dog training services. By participating in our training programs, you agree to the terms outlined below.

1. Program Participation Requirements

1.1. Eligibility

The Client must ensure that their dog meets the eligibility criteria for the chosen training program. This includes age, health, and behavioral considerations.

1.2. Vaccinations and Health

The Client agrees to provide proof of up-to-date vaccinations and ensure their dog is in good health. We reserve the right to refuse training services if health or safety concerns arise.

1.3. Behavioral Assessment

Prior to enrollment, the Trainer will assess the dog’s behavior to determine the most suitable training approach. Honest disclosure of any aggression or behavioral issues is essential.

1.4. Pack Member Code of Conduct

As part of our commitment to maintaining a positive and respectful training environment, we require all clients to review and adhere to our Pack Member Code of Conduct. This code outlines behavioral expectations for both humans and their canine companions during training sessions. You can find the full details in our Code of Conduct.

2. No Guarantees on Results

2.1. Training Outcomes

While we strive for positive results, we cannot guarantee specific behavioral changes. Each dog responds differently to training, and success depends on various factors, including consistency and follow-through by the Client.

2.2. Client Commitment

The Client acknowledges that successful training requires active participation, practice, and reinforcement outside of formal sessions.

3. Payment Terms

3.1. Fees

Payment for training services is due at the time of each session unless a payment arrangement has been agreed upon in advance.

3.2. Cancellation and Rescheduling

The Client must provide at least 24 hours’ notice for cancellations or rescheduling. Missed sessions without proper notice may be subject to a fee.

3.3. Refunds

No refunds will be issued once training sessions have commenced.

4. Liability and Release

4.1. Assumption of Risk

The Client understands that dog training involves inherent risks, including but not limited to injury or property damage. The Client assumes all responsibility for their dog’s behavior during and after training.

4.2. Indemnification

The Client agrees to indemnify and hold the Trainer or California Cattle Dogs harmless from any claims, damages, or liabilities arising from the dog’s participation in training.

4.3. LIMITED LIABILITY

IN NO EVENT SHALL THE TRAINER BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES ARISING OUT OF OR RELATING TO THE DOG TRAINING SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF LIFE OR QUALITY OF LIFE, PERSONAL INJURY TO PEOPLE OR ANIMALS, CIVIL OR CRIMINAL CITATIONS, OR DAMAGE TO PROPERTY. THE TRAINER’S TOTAL LIABILITY UNDER THIS AGREEMENT SHALL NOT EXCEED THE TOTAL FEES PAID BY THE CLIENT FOR THE SPECIFIC TRAINING SERVICES RENDERED.

4.4. Restrictions and Limitations

5. Confidentiality

5.1. Privacy

Any information shared during training sessions will be kept confidential. We respect your privacy and will not disclose personal details without your consent. For more details on how we handle your information, please refer to our Privacy Policy.

6. Termination

6.1. Termination by Either Party

Either party may terminate this Agreement with written notice. If terminated by the Client, any unused prepaid sessions will not be refunded.

7. Miscellaneous

7.1. Governing Law

This Agreement shall be governed by the laws of the State of California.

7.2. Entire Agreement

This Agreement constitutes the entire understanding between the parties and supersedes all prior agreements for Dog Training Services, whether written or oral.

7.3. Severability

If any provision of this Agreement is found to be invalid or unenforceable, only that provision shall be removed; the remaining provisions shall remain in full force and effect.

8. Agreement Term

8.1. Duration

The initial term of this Agreement shall be 6 months from the date of enrollment.

8.2. Automatic Renewal

Unless either party provides written notice of termination at least 30 days before the end of the initial term or any subsequent renewal term, this Agreement will automatically renew for additional 6-month periods.

8.3. Updated Terms and Conditions

This Agreement is subject to any updated terms and conditions as posted on our website. It is the Client’s responsibility to review such updates periodically.

8.4. Payment Constitutes Agreement

Payment for services of any kind related to Dog Training constitutes your consent to this agreement and is effective as if it were your signature on a legal document. The Agreement Term begins the day that the first payment is received for any Dog Training services from the Trainer.
